Terms of Service – PesTown

1. Parties and Scope

These Terms of Service govern the relationship between PesTown ("Platform") and individuals or entities ("User") who access and use the Platform. By registering, you agree to these terms.

2. Scope of Service

PesTown is a web-based software platform for pest control companies, providing customer management, job tracking, quoting, chemical logging and reporting. The Platform is offered on a subscription basis and the scope of service depends on the selected plan.

3. Account and Security

You are responsible for keeping your account information accurate and up to date.
You must not share your account with third parties.
You must immediately report any unauthorized access to your account.
The Platform is not liable for losses resulting from suspicious activity on your account.

4. Subscription and Payment

Subscription fees are billed monthly. Non-payment may result in account suspension. Cancellation takes effect at the end of the current billing period; no refund is issued for the remaining period. Prices may change with prior notice.

5. Acceptable Use

The following are prohibited when using the Platform:

Using the Platform for illegal activities
Using tools that could damage Platform infrastructure
Attempting unauthorized access to other users' data
Exploiting the Platform with automated tools (scraping, bots, etc.)
Infringing intellectual property rights

6. Data Ownership

Customer, job and operations data you enter on the Platform belongs to you. The Platform uses this data solely to provide the service. Upon closing your account, you have 30 days to export your data; after that it is permanently deleted.

7. Service Availability

The Platform targets 99%+ uptime; however, temporary outages may occur due to maintenance, updates or unexpected technical issues. The Platform is not liable for indirect damages resulting from outages.

8. Intellectual Property

The Platform's software, design, logo and content are owned by PesTown. Users are granted a limited, non-transferable, non-exclusive license to use the Platform. Copying, distributing or creating derivative works from any part of the Platform is prohibited.

9. Account Termination

The Platform may suspend or terminate accounts that violate these terms without prior notice. Users may also close their account at any time.

10. Limitation of Liability

To the maximum extent permitted by applicable law, the Platform is not liable for indirect, incidental or consequential damages. The Platform's total liability for any given month shall not exceed the subscription fee paid for that month.

11. Governing Law

These terms are governed by the laws of the State of Delaware, United States. Disputes shall be resolved in courts located in Delaware.

12. Changes

These terms may be updated with prior notice. Continued use of the Platform after updates are published constitutes acceptance of the new terms.
